Every sale deed, lease deed, and power of attorney relating to immovable property in Chhattisgarh attracts stamp duty under the Indian Stamp Act, 1899 as applicable to the state, plus a separate registration fee under the Registration Act, 1908. For businesses acquiring or leasing commercial premises, warehouses, or industrial land in Raipur and elsewhere in the state, getting this calculation right upfront avoids both under-stamping penalties and unnecessary overpayment.

Property value for this computation is the higher of the actual consideration stated in the sale deed or the Collector's Guideline Value (Circle Rate) notified for that locality — a sale deed cannot be registered at a value below the applicable guideline rate without inviting a Section 47A reference for undervaluation.

Minimum registration fee: For transactions valued at ₹50,000 or below, Chhattisgarh applies a flat registration fee of ₹500 instead of the percentage-based charge.

Time limit for registration: Under Section 23 of the Registration Act, 1908, the executed document must be presented for registration within four months of its execution date, or it becomes liable to a delay-condonation application (with penalty) before the Registrar, and beyond a further extended window, registration can be refused altogether.

2. Stamp Duty on Commercial Lease Deeds

Lease deed stamp duty in Chhattisgarh, as under the Indian Stamp Act framework generally, is calculated differently from a sale deed — it is based on the average annual rent payable (and, where applicable, any premium/security deposit that is non-refundable or adjustable against rent), with the duty rate varying by the term of the lease:

  • Short-term leases (up to a defined number of years, commonly structured as leave-and-license or short lease periods) attract stamp duty computed as a percentage of the average annual rent for that period.
  • Long-term leases (commonly leases exceeding 10 years, or perpetual/renewable leases) are typically stamped closer to conveyance (sale-deed-equivalent) rates on the total value of rent payable over the lease term or the property value, whichever framework the specific lease structure attracts.
  • Refundable interest-free security deposits are generally treated differently from non-refundable premium payments for duty computation — only the portion effectively forming part of the consideration for the lease (not a pure refundable deposit) is typically brought into the duty base, though this distinction is frequently scrutinised by the Registrar and should be structured carefully in the lease deed's recitals.

Practical Guidance for Industrial/Warehouse Leases: Because the applicable duty band depends heavily on the exact lease tenure and the precise structuring of rent escalation clauses and deposits, businesses entering long-term industrial or warehouse lease agreements in Chhattisgarh should have the draft lease deed reviewed for stamp duty computation before execution — restructuring a clause after the deed is signed and presented for registration is far more difficult (and may itself attract additional duty) than getting it right in drafting.

3. Stamp Duty on Power of Attorney (POA)

A Power of Attorney executed for property-related purposes in Chhattisgarh is separately chargeable to stamp duty, with the rate depending on the nature of the POA:

  • A General Power of Attorney (GPA) authorising a person to manage property affairs generally attracts a materially lower, largely nominal duty compared to conveyance.
  • A POA that effectively authorises the attorney to sell the property, particularly where executed for consideration or in favour of a person other than a close family member (as defined for concessional treatment in various states' stamp legislation), is often treated at a duty rate approaching that of a conveyance, since courts and revenue authorities have consistently viewed a "sale POA" as economically equivalent to a transfer.

Given this is one of the more frequently litigated and state-notification-sensitive areas of stamp duty, businesses using a POA structure for property transactions (common in industrial land assembly or where the registered owner cannot personally execute documents) should confirm the current applicable rate and structuring with the Sub-Registrar's office or a practicing professional before execution, rather than relying on a general POA duty assumption.

4. Municipal/Additional Surcharges

Beyond the base stamp duty and registration fee, property transactions within notified municipal corporation limits (including Raipur Municipal Corporation) may attract an additional surcharge earmarked for municipal/infrastructure development, layered on top of the base stamp duty percentage. This surcharge component should be confirmed at the time of deed drafting, as it directly affects the total duty payable and is calculated on the same property-value base as the principal duty.

5. Practical Checklist Before Executing a Commercial Property Document

  • Confirm the current Collector's Guideline Value for the specific locality/ward — never rely on a value from a prior year's transaction
  • Identify the correct buyer category (male/female/joint) to apply the right stamp duty percentage
  • For leases, finalise the exact tenure and rent structure before drafting, since duty computation depends directly on these terms
  • Verify whether the transaction falls within a municipal corporation area attracting additional surcharge
  • Present the executed document for registration within the four-month statutory window
  • For POA-based structures, get the specific POA type's duty confirmed rather than assuming the lower "general" rate applies
